By using an App or our website, you consent to the terms and provisions of this Policy, including our collection, use, storage and disclosure of User Information as described in this Policy. Drivers also expressly consent to our use of location-based services and expressly waive and release us from any and all liability, claims, causes of action or damages arising from a Driver’s use of the K&GO Driver App, or in any way relating to the use of your precise location and other location-based services. If you do not wish to consent to the terms and provisions of this Policy, you must not access any App or request or provide any services from or to the Company.
Mobile platforms define the types of data that applications on your mobile device can or cannot access without your consent. The permission systems for obtaining your consent vary with the platform your mobile device uses. You can manage permissions on your mobile device and choose whether to provide certain permissions to our Apps.
This Policy applies to the all products and services offered by the Company. Certain provisions of this Policy apply only to users of the K&GO Driver App who serve as drivers for the Company (the “Drivers”), while other provisions of this Policy apply only to users of the K&GO App who request the performance of services (the “Requesters”). Additionally, certain provisions of this Policy apply only to the minors on whose behalf a User requests services be performed (the “Minors”). Unless specifically noted in a specific provision, this Policy applies to all Users, including without limitation Requesters, Drivers, and Minors. The terms of this Policy apply in addition to any other agreements you have entered into, or may enter into in the future, with the Company.
How we collect information from you
We collect information, including without limitation personal identification information, from Users (“User Information”) in a variety of ways. You may directly provide User Information to us when you (1) create or modify your account, (2) request services or agree to provide services via one of our Apps, (3) contact customer support, (4) subscribe to a newsletter or other email offering, (5) fill out a form, or (6) communicate with the Company or any of its representatives in any other way. The information we collect may include: name, email address, mailing address, phone number, credit card or other payment information, payment method, profile picture, instructions related to specific services to be provided, and any other information you choose to provide.
In addition to User Information that we collect directly from you, we also collect information through your use of the Apps, including (1) location information, (2) transaction information, (3) usage information, (4) preference information, (5) device information, (6) call and SMS data and (7) log information.
Location Information: When a Requester uses the K&GO App to request transportation for a Minor, we collect precise location data about the trip from the K&GO Driver App, including the location at which a Minor is to be picked up, the drop-off location for a Minor, and the route taken by the Driver. Drivers do not have the option of denying the K&GO Driver App permission to collect this information. If a Requester permits the K&GO App to access location services through the permission system used by your mobile platform, we may also collect the precise location of your device when the K&GO App is running in the foreground or background, whether or not you are in the same location as the Minor on whose behalf services will be provided. We may also derive your approximate location from your IP address.
Transaction Information: We collect transaction details related to your use of the Apps, including the service requested, the Minor on whose behalf the service is requested, the date and time of the provision of the service, the amount charged, the distance traveled, and other related transaction details (including without limitation whether any additional charges were applied in connection with the transaction). This information is collected for both Requesters and Drivers.
Device Information: We may collect information about your mobile device or computer, including without limitation the model, operating system and version, software names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
Call and SMS Data: Our Apps facilitates communication between Requesters and Drivers. In connection with facilitating this service, we receive call data, including the date and time of calls or SMS messages, Users’ phone numbers, and the content of SMS messages.
Log Information: When you interact with the Apps, we collect server logs, which may include information like mobile device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with the Apps.
We may also receive information about you from other sources that we combine with what we collect through the Apps. If you choose to link, create, or log in to your User account with a payment provider (e.g., Google Wallet) or social media service (e.g., Facebook), or if you engage with a separate app or website that uses our API (or whose API we use), we may receive information about you or your connections from that site or app. When a Requester requests services, our Drivers may provide us with a rating after providing services to you and the applicable Minor and may provide feedback on you and/or the Minor. When a Driver provides services, our Requesters may provide us with a rating after the services have been provided by you. If you are both a Requester and a Driver, we may combine or associate information we have collected from you in all capacities.
How we protect User Information
We have adopted data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on the server that hosts our data that are in conformity with industry standards for the protection of sensitive information.
Sensitive and private data exchange between the Apps and Users happens over a SMS platform-based secured communication channel and is encrypted and protected. However, “perfect security” does not exist on the Internet. All Users should protect their login information and not share it with third parties, including, as applicable, Minors. The Company will never ask you for your login credentials via email. If the Apps contain links to other sites, we are not responsible for the security practices or the content of such services.
How we use User Information:
We may collect information from you for business purposes, including without limitation for marketing, lead generation, service development and improvement, analytics, industry and market research, and such other purposes consistent with our legitimate business needs.
Specifically, we may use information that we collect about you to:
● provide, maintain, and improve the Apps, including, for example, to facilitate payments, send receipts, provide products and services you request or provide (and send related information), develop new features, provide customer support to Requesters and Drivers, develop safety features, authenticate Users, and send product updates and administrative messages;
● perform internal operations, including, for example, to prevent fraud and abuse of the Apps; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;
● send or facilitate communications between Requesters and Drivers, such as estimated times of arrival (ETAs);
● send you communications we think will be of interest to you, including information about products, new services, promotions, news, and events, where permissible and according to local applicable laws; and to process contest, sweepstakes, or other promotion entries, if applicable, and fulfill any related awards;
● personalize and improve the Apps, including to provide or recommend features, content, social connections, referrals, and advertisements; and
● perform research and analysis about your use of the Apps.
We will retain any information only for as long as is necessary to fulfill the business purpose it was collected. We will also retain and use User Information for as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Information collected from you may be stored and processed in the United States or any other country in which the Company or agents or contractors work or maintain facilities. The laws on processing personal information may be less stringent than in the United States.
How we share User Information
We do not sell, trade, or rent User Information to third parties for commercial purposes without Users’ consent except as set forth in this paragraph. User Information is protected and cannot be accessed by anyone other than the Company without Users’ consent. If we work with one or more strategic partners or third parties, we limit the disclosure and use of the User Information to the tasks assigned to the strategic partner or third party. By using either of the Apps, you consent to our limited disclosure of User Information in connection with our relationships with such strategic partners or third parties. We may, however, share User Information through the Apps (a) to enable Users to use or provide services, such as by sharing the name and photograph of Requesters and Minors, the average ratings given to Users, pick-up and drop-off locations, and specific instructions Requesters provide in connection with a specific Minor. (b) with third parties to provide a service that you’ve requested through a partnership or promotional offering made by a third party or us, (c) with the public, but only to the extent you submit content in a public forum, and (d) with third parties with whom you choose to let us share User Information.
Under some circumstances, we may also share User Information:
● with vendors, consultants, and other service providers that we engage who need access to such information to perform services on the Company’s behalf;
● in response to a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process;
● with law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with your agreements with the Company, terms of service, or policies, or to protect the rights, property, or safety of the Company or others;
● in connection with, or during negotiations of, any financing, merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company;
● in an aggregated and/or anonymized form which cannot reasonably be used to identify you;
● if it is necessary, in our sole discretion, to protect the safety, rights, property, or security of the Company, the Apps or website, or any third party; to detect, prevent or otherwise address fraud, security or technical issues; and/or to prevent or stop activity which the Company, in its sole discretion, considers to be, or to pose a risk of being, illegal, unethical, or legally actionable; and
● if we otherwise notify you and you consent to the sharing.
Specifically for Drivers, we may also share information with third parties if:
● there is a complaint, dispute or conflict, including an accident, relating to a Driver; and
● it is necessary to enforce the terms of our agreements.
Compliance with children’s online privacy protection act
Although our services are intended to facilitate the planning, scheduling and coordination of providing transportation of Minors, use of our Apps and the services we provide is restricted to adults over the age of 18. Parents and guardians may provide information about their children, but we do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for the services. If you are under 13, please do not attempt to register for the services or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to us or on the services. If we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Your Rights and Choices
If your personal information changes, or if you no longer desire to use the Apps, you may correct, update, or delete inaccuracies by making the change within your account settings or by contacting us at firstname.lastname@example.org.
We will comply with individual’s requests regarding access, correction, and/or deletion of personal information we store in accordance with applicable law.
We request permission for the App’s collection of precise location from a Requester’s device per the permission system used by your mobile operating system. If you initially permit the collection of this information, you can later disable it by changing the location settings on your mobile device. However, this will limit a Requester’s ability to use certain features of the App. Additionally, disabling the Apps’ collection of precise location from a Requester’s device will not limit our ability to collect a Requester’s trip location information from the Driver’s device nor our ability to derive approximate location from a Requester’s IP address. Drivers do not have the option to turn off our collection of a Driver’s precise location.
You may opt out of receiving promotional messages from us by following the instructions in those messages. If you opt out, we may still send you non-promotional communications, such as those about your account, about the services you have requested, or our ongoing business relations.
